We had a contingency contract (signed 5/31/08) on our home with a couple from GA, who first needed to sell their home to purchase ours. This contract was set to expire 8/29/08. Our realtor contacted me on 7/20/08 to notify that this contract was no longer in place due to the potential buyers taking their home off of the market. Our realtor cannot recall who told her this, but claims that some man called her and gave her this information. The couple from GA showed up at our home approximately 2 weeks later (8/2)to look at our home again and assure us that they were aggressively trying to sell their home. We were stunned to hear this, and they were stunned to hear that we were under the impression we no longer had a contract. They were so irritated and disheartened by this that they no longer wanted to pursue our home. The reason we lost this contract on our home is due to our realtor's careless mistake. This realtor did not even present us with any paperwork to sign in order to end this contract, she simply said that someone had called her and told her it was no longer. I have approached the realtor and Coldwell Banker broker at this office in order to receive acknowledgement of their unprofessional ways and mistakes, as well as compensation for this hardship of loosing a promising buyer. The realtor maintained she did nothing wrong. The broker also downplayed the importance of this contract, by saying that due to it being a contingency contract, it is not looked at as a real contract, but simply a "maybe." I don't understand why you sign legal documents if this is such a trivial matter. And it was very important to us and the potential buyers! I contacted the realtor of this couple from GA, and their realtor informed that she had not heard from our realtor since we had signed the contract in May. She also advised that we could have been sued if we had entered into another contract due to this contract still being in place. Also, our realtor hardly ever called us. I waited literally a month to call her after not hearing from her. When i requested she contact us at least once every two weeks to keep us updated, she replied, "since I'm so busy and you're not working, why don't you call me." Losing this contract was such a huge let down to me and my husband, as we have been trying to sell our home in this tough market for nearly 7 months. This realtor responded that this situation was "minute." (or in other words trivial) I requested that fair compensation would be to assist us with the costs / fees of re-listing our home for sale by owner on the MLS (as we were released from the contract with this realtor). They declined. However, at the very least, this "so-called professional" could have owned up to her vital mistakes and careless handling of our real estate needs.
